Terms of Service

1. Account Eligibility & Stewardship

• One Human, One Free Account: To maintain the quality of our digital neighborhood, free tier users are permitted to create only one (1) account per person. Building or running automated networks of free accounts is strictly prohibited and will result in immediate termination of all related accounts.
• Upgrading for Scale: If you require more sites, higher limits, or custom domains, you must upgrade to a paid tier (Resident or Guardian). Upgrading directly supports our mission of maintaining an independent, human-centric web sanctuary.
• Digital Stewardship: You are solely responsible for maintaining the confidentiality and security of your login credentials. You assume full responsibility for all content, scripts, and activities occurring under your subdomains or mapped custom domains.

2. Content, Conduct & Prohibited Activities

We are a haven for creativity, not a lawless wild west. ZenDenPen reserves the right to review, block, or delete any content at our sole discretion. The following categories of content and activity are strictly prohibited:

• Illegal Activities: Any content or action that violates local, national, or international laws, including fraud, harassment, and human trafficking.
• Pornography: We do not host adult, explicit, or pornographic content of any kind.
• Copyright Infringement: You may not host files (such as music, movies, books, or proprietary software) that you do not legally own or have explicit license to distribute. We comply with valid copyright take-down notices.
• Malicious Actions & Hacking: You must not attempt to hack, brute-force, reverse-engineer, or probe our infrastructure for vulnerabilities. If you discover a security flaw, please report it to us responsibly; exploiting or publishing it without our consent is a violation of these terms.
• DDoS & Abuse of Infrastructure: Any form of automated scraping, rate-limit bypassing, spamming, denial of service (DoS/DDoS) attacks, or activities designed to overload, degrade, or disrupt the performance and availability of our servers is strictly prohibited. Automated bot networks interacting with our deployment API or frontend will be immediately banned.
• AI Slop & Automation: We value handcrafted, human-centric web design. The deployment of mass-generated automated spam pages, SEO scrapers, or automatic "slop" feeds is prohibited to preserve the integrity of our community.

3. Storage & Bandwidth Allocation

To ensure system stability, speed, and fairness for all neighbors, the following resource caps apply to your account:

* Paid tiers must purchase their own custom domains independently from a registrar.

Enforcement Policy: We do not use aggressive, cold automation to instantly cut you off the second you exceed a limit. However, if limits are significantly or repeatedly breached, we reserve the right to throttle, restrict, suspend, or adjust offerings as necessary to keep our shared infrastructure sustainable.

4. Zero-Refund Policy & Account Donation Exception

• Unlimited Free Evaluation: We provide an unlimited, fully functional Free Den tier. No credit card is required to sign up. You are strongly encouraged to test every aspect of the platform thoroughly before making any financial commitment.
• Instant Digital Provisioning & Waiver: All paid tiers are digital services that are instantly provisioned upon payment. By purchasing a Resident or Guardian plan, you explicitly acknowledge and agree that **no refunds or 14-day statutory withdrawal periods apply** under EU Consumer Law, as the service is fully rendered immediately upon checkout.
• The "Donation" Exception: If you purchase a plan and find you no longer need it, we cannot issue a refund. However, you can contact us to **donate your remaining time and account credit** to another person or indie creator of your choosing. We will happily transfer the subscription to support someone else in the neighborhood.

5. Legal Disclaimers, Liability, & Indemnification

5.1 NO WARRANTY ("AS-IS" & "AS-AVAILABLE")

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, SECURITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ACCEPT ALL RISK CONCERNING DATA LOSS, SYSTEM INTEGRITY, SECURITY EXPLOITS, OR WEBSITE DOWNTIME.

5.2 ABSOLUTE LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, FOUNDER, OR DEVELOPER OF ZENDENPEN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION.

IF ANY DISPUTE, LITIGATION, OR ARBITRATION ARISES FROM OR RELATES TO THIS AGREEMENT OR THE USE OF THE SERVICES, ZENDENPEN'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL SUM ACTUALLY PAID BY YOU TO ZENDENPEN DURING YOUR ACTIVE MEMBERSHIP PERIOD, EVEN IF THAT AMOUNT IS ZERO.

5.3 INDEMNIFICATION

You agree to defend, indemnify, and hold harmless ZenDenPen, its operator, and contributors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, or expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term within these Terms; or (c) any content or code you host on your site that violates third-party rights, local laws, or copyrights.

6. Service Level Agreement (SLA) & Uptime Disclaimer

We love the web and promise to do our absolute best to keep your "dens" blazing fast and constantly online. However, we do not provide a legally binding or guaranteed uptime SLA.

The availability of ZenDenPen depends on third-party factors outside our control, including global backbone internet routing, ISP connectivity, regional outages at our cloud/datacenter providers, and localized force majeure events. We are not liable for any losses, business interruptions, or missing metrics during infrastructure maintenance or unpredictable downtime.

7. Discretionary Suspension & Termination

We reserve the right, at our absolute and sole discretion, to modify, suspend, or terminate your account and delete your files from our servers at any time, with or without prior notice, if we detect any form of abuse, illegality, network disruption, or behavior we deem harmful to the health and peace of our community. ZenDenPen is the final arbiter of what constitutes abuse.

8. Changes to Terms & Governing Law

We reserve the right to update these terms at any time. Continued use of the service following any updates constitutes automatic acceptance of the modified Terms of Service. These Terms shall be governed and construed in accordance with the laws of Romania and the European Union, without regard to its conflict of law provisions.
